1. Purpose
These terms govern the use of TheDiffuseur, a service published by LMVI Conseil, a SARL with SIREN 949 417 620, available at app.thediffuseur.com.
By creating an account or using the service, you accept them. If you do not accept them, do not use the service.
2. What the service does
TheDiffuseur receives files and texts that you upload, organises them into series and episodes, derives a publishing calendar from them according to the rules you set, and
publishes this content to the social network accounts that you have yourself connected, on the scheduled dates and at the scheduled times.
The service does not write your content, does not modify it of its own accord, and publishes nothing that you have not scheduled. The only feature that produces anything — the production of a document from the pieces you select — returns a draft that is never published without your approval.
3. Access and account — a business-to-business service
TheDiffuseur is offered exclusively to professionals: companies, sole traders, associations and organisations acting in the course of their business. It is not offered to consumers, and the provisions of the French Consumer Code — right of withdrawal, consumer mediation — do not apply.
You must have the legal capacity to contract. If you use the service on behalf of an organisation, you declare that you have the authority to bind it.
You are responsible for the confidentiality of your credentials and for everything done from your account. Notify us without delay if you suspect unauthorised access:

4. Connecting third-party accounts
You connect your social network accounts through each platform’s official mechanisms.
You must be the legitimate holder or administrator of each account you connect.
You can disconnect an account at any time: the token is then deleted immediately, and the publications still scheduled to that account will not go out.
5. Platform terms apply as well
Publishing through TheDiffuseur does not exempt you from anything. Each platform has its own terms, its community guidelines and its policies — on music rights, branded content, sponsored content, minors. You undertake to comply with them.
A platform may, of its own accord, remove content, restrict or close your account. We have no power over these decisions and are not answerable for them.
6. Your content
It remains yours. We claim no ownership of it.
You grant us only the licence necessary for the performance of the service: to store, convert format, resize, and transmit your content to the destinations you have designated. This licence ends when you delete the content or your account.
You warrant that you hold the rights to what you upload — including to the images, the music and the voices — and that this content infringes neither the law nor the rights of a third party.
7. Prohibited uses
It is prohibited to use the service to:
- distribute unlawful, hateful or defamatory content, or content that undermines the dignity of persons;
- distribute content to which you do not hold the rights;
- send unsolicited bulk messages, or circumvent a platform’s rate limits;
- impersonate a third party, or publish to an account of which you are not the legitimate holder;
- attempt to access another user’s data, or to probe or disrupt the infrastructure;
- resell access to the service without written agreement.
8. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these terms.
9. Availability
The service is provided “as is”, with no guarantee of uninterrupted availability. Interruptions may occur for maintenance, because of an incident, or because of a third party — hosting provider or destination platform.
We endeavour to announce scheduled maintenance, and to place it outside the usual publishing hours.
A publication may fail for reasons beyond our control: platform unavailable, quota reached, token revoked, content refused. The service retries where the failure is temporary, and reports back to you in all cases, but does not guarantee that a given publication will succeed.
10. Changes to the service
Features may evolve. An essential feature will not be withdrawn without reasonable prior notice sent to your account’s address.
11. Suspension and termination
You may close your account at any time — see the Data deletion page.
We may suspend or close an account in the event of a breach of articles 6 or 7, of a risk to the security of the service, or of a legal obligation. Except in an emergency or where an obligation requires otherwise, you are notified and given the opportunity to respond.
12. Intellectual property
The service, its code, its interface and its trade marks belong to LMVI Conseil. These terms transfer no right in them to you, other than the right to use the service in accordance with its terms.
13. Liability
To the extent permitted by law, we cannot be held liable for indirect damage — loss of audience, loss of turnover, damage to reputation — resulting from the use or the unavailability of the service.
For a paid service, our total liability is capped at the sums paid during the twelve months preceding the triggering event. For a free service, it is limited to the minimum permitted by law.
Nothing here excludes liability that cannot be excluded under French law, in particular in the event of gross negligence, wilful misconduct, or harm to persons.
14. Changes to the terms
Any substantial change will be indicated on this page, with a new date, and announced to your account’s address at least thirty days before it takes effect. Continuing to use the service after that date constitutes acceptance.
15. Governing law
These terms are governed by French law.
In the event of a dispute, an amicable solution will be sought by writing to
[email protected]. Failing that, and the service being reserved for professionals (article 3), the courts of Nantes, France have jurisdiction.
